We reserve the right to decline or discontinue any service at our discretion.
All estimates are provided in writing and are based on information available at the time of the site visit. Estimates are not guaranteed-price contracts. Final project costs may differ from initial estimates if unforeseen site conditions are discovered during construction, if the client requests changes to the scope of work, or if material costs change significantly between the estimate and the project start date.
Any changes to the original scope of work must be agreed to in writing by both parties before additional work is performed. We will provide a written change order describing the additional work, cost, and any impact on the project timeline.
Project start dates are subject to permit approval timelines, material availability, and scheduling capacity. We will communicate expected start dates in writing and will notify you of any delays as soon as they are known.
If you need to cancel or reschedule a project after a contract has been signed, please notify us in writing as soon as possible. Any cancellation fees or deposit retention policies will be outlined in the written contract for your specific project. Materials ordered or work already performed prior to cancellation may be billed accordingly.
Payment schedules are outlined in the written contract for each project. Typically, a deposit is required before work begins, with progress payments due at defined milestones and a final balance due upon project completion. Specific amounts and due dates will be stated in your contract.
Invoices not paid by the due date specified in the contract may be subject to late fees as stated in the contract. We reserve the right to suspend work on a project in the event of non-payment.
Where required by local ordinance, Pacific Grove Fence & Deck will obtain building permits on your behalf as part of the contracted work. You are responsible for ensuring that your property complies with any applicable homeowners association rules, deed restrictions, or easements before work begins. We are not responsible for delays or costs arising from property restrictions that were not disclosed before work began.
We stand behind our workmanship. Any workmanship warranty applicable to your project will be stated in your written contract. Materials are covered by the manufacturer's warranty, not by us directly. Warranty claims related to materials should be directed to the manufacturer.
Warranties do not cover damage resulting from misuse, neglect, failure to perform recommended maintenance, acts of nature, or modifications made by anyone other than Pacific Grove Fence & Deck.
EXCEPT AS EXPRESSLY STATED IN YOUR WRITTEN CONTRACT, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the fullest extent permitted by law, Pacific Grove Fence & Deck's total liability to you for any claim arising out of or related to our services or this website shall not exceed the total amount paid by you to us for the specific project giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, loss of use, or damage to property not directly related to our work, even if we have been advised of the possibility of such damages.
